College vs. High School Essay

There is so much freedom and you must use your time wisely in order to succeed. When you get to the university you will find you meet all sorts of people from all over the place with so many different cultural backgrounds and religions and beliefs and opinions. You get exposed to new ideas and new experiences. The classes are very different too. If you live on campus, it will likely be your first time living away from home, which is a huge experience. And once you find your major, you will find your people. You will actually be going to school with people who want to be there. As opposed to high school where students have to be there and many can careless about the subjects. College is a completely new experience with many unique aspects that can change and help define one’s life. Many people love college, and find it to be a new beginning. It is a new opportunity to define yourself as an individual. You can establish a new image, because everyone is looking to do the exact same thing. In college, it’s time to strap down and get to work. There’s really no room for error. Classes are spread out throughout the week, and you often have much down time. There is a lot of work and it is crammed into a short period. It is up to you to know when to eat lunch, and it is up to you when to study. It is also your decision to fill that time where you are not studying or doing work with productive things. High school is a period in which many new things happen. You now find yourself in a world full of raging hormones, honors classes, and new found freedoms. High school is routine in a way. You have your eight or so classes year round, and you know when you will be eating lunch. The same kids you went to elementary and middle school with probably are the same kids you went to high school with. Basically, high school is much regimented, and many people find themselves having the same friends for many years. Because of this, in turn once a â€Å"reputation† or â€Å"image† was established for you in high school, most likely that was going to stick with you for the rest of your time left. The work in high school is a piece of cake. Unless you are taking honors or AP courses, there is really no reason why someone’s GPA should drop below 2. 5. Classes in high school are small in size, usually between twenty and thirty students, and there is a one on one feeling with the teacher. It is a laid back atmosphere because everyone knows each other. Also in high school, many students find a way around the â€Å"school† part. Countless students slack off and don’t apply themselves to their work or studies. Because of this, many students find themselves doing new extracurricular activities, and I think we all know what is meant by that. It is very easy in high school to fall into bad habits. High School is a perfect opportunity to go down the wrong path and find yourself in bad situations. In conclusion, even though high school is an important step in life, college is an even bigger step. They are similar in some ways but in others they are the same. High school prepares you for college. It is a time full of new experiences and lessons. College is a new chapter in life and you can basically start over. In a way, college is a mature version of high school. High school and college are what you make of it. To find the true similarities and differences, one must experience both for themselves.

The Pursuit of Self-Identification

In the novel The Jade Peony, author, Wayson Choy, intelligently writes about two siblings who struggle in the pursuit of self-identification. Their struggles vary as they do not share the same problems during this tough period of their lives. This leads to the debate, whose childhood experiences will affect them more as an adult? Although Jook-Liang had to go through the tough situation of always being under prioritized and always being undermined, her childhood troubles and experiences could never truly be compared with the experiences of Jung Sum.To put it bluntly, Jung Sum’s childhood experiences will affect him more as an adult than Jook-Liang’s experiences would. The reason for this is because, firstly, Jung Sum, as a child, was never truly showered with love, neither was Jook-Liang, but she did not have to suffer the pain of losing her birth parents as Jung Sum did. Also, Jung Sum had to experience the pain of losing a treasured person or pet multiple times, and w hile Jook-Liang did lose a person close to her heart, she only experienced it once.Finally, as both Jook-Liang and Jung Sum struggled with identification, Jung Sum was met with problems while identifying his sexual identity, which was not accepted by any society at that period of time. On the other hand Jook-Liang was only required to identify culturally which would cause problems but eventually allow gain acceptance into at least one society. To start with, Jung Sum never had the privilege of being showered with love during his childhood and even though Jook-Liang was greatly oppressed and unfairly treated by people around her, such as Poh-Poh, she would still ocassionally be loved by those surrounding people.This is evident when Poh-Poh helped Jook-Liang to tie her shoelaces while she was getting ready to dance for Wong Suk (Choy 30). As for Jung Sum, although he was only a child, his birth father would violently abuse him and his mother when he was drunk. The quote â€Å"I waite d for Daddy to get up from the kitchen floor, half-drunk, waited for him to beat me with his belt. † (Choy 96) clearly shows that Jung Sum had to face the unlucky circumstances of child abuse, something Jook-Liang had the privilege of avoiding as her family never resorted to physical abuse.It would be a scarring memory to be violently abused by ones’ own father as a child, a memory that could be carried for a lifetime. This may affect Jung Sum in his latter years as he may recall the abuse of his father and feel dysfunctional. These unresolved issues could cause a severe case of depression in his life. Furthermore, as Jung Sum was adopted into a new family, he immediately felt like an outsider. â€Å"He thought I was too weak to be his brother, a real brother,† (Choy 93) shows that Jung Sum clearly felt marginalized by his new older brother, Kiam.To be adopted into a family full of new and unfamiliar faces and be rebuked immediately by his own â€Å"brother† was a tough situation to be in, especially after losing both his parents. Jook-Liang did not have to go through the process of being adopted into a new family or having to lose her family members prematurely while Jung Sum did. This could possibly go on to affect Jung Sum and make him feel as though he had no one to rely on but himself, possibly causing him to have a lack of trust for other people in the future.Additionally, his childhood experiences may lead him to develop into an adult influenced by those experiences. These unresolved child issues could dwell within him and could cause him to either be more aggressive or more reserved as an adult. He may recall those experiences when dealing with his own children in the future and could possibly treat them the same way his own father treated him or otherwise, might not even attempt to have a close relationship with them.As Jook-Liang did not undergo any extreme circumstances of child abuse, she would probably be less affected a s an adult when compared to Jung Sum. Therefore, Jung Sum has a relatively greater impact on his future life from his adolescent experiences as his experiences produces permanent scars where the problem was not greatly alleviated afterwards. Another problem faced by both of the siblings was with different aspects of identification. Jook-Liang had to struggle with cultural identification while Jung Sum faced problems with sexual identification.Homosexuality is an unaccepted identification which will not be tolerated by any society back in the 1930s, while switching cultural identities will still allow the person to gain acceptance in at least one society. His sexual identity was first suggested in the novel by Poh-Poh as he says that â€Å"Jung Sum is the moon† (Choy 88). Jung Sum then figures out his own sexual identity as it was Frank Yuen that he desired most at that moment during Frank Yuen’s farewell instead of courage (Choy 138) and that â€Å"Frank Yuen is the S un† (Choy 132) while he is the moon.Having to figure out his own sexual identity at such a young age without any guidance was a hard chore as back then love relationships were known to be present only between females and males. In addition, love between the same gender was not only unaccepted in the society, it was greatly rejected. As a result, Jung Sum had to keep his love for the same gender a secret. The inability to reveal his sexual identification would cause him to have the lack of freedom in the pursuit of a preferred life partner.This could affect his happiness as a whole as he is unable to share life experiences in the love aspect of his life as others normally do because of the inability to express his love for his preferred partner. On the other hand, even though Jook-Liang struggled with her cultural identity, no matter which culture she decides to identify with, she would be still accepted, eventually. Jook-Liang’s desire to assimilate into another culture is evidently shown as she looks up to Shirley Temple, an American dancer and actress.Wanting to assimilate into the western culture, she even hoped to see her own reflection in the mirror possessing a westerner’s features, specifically, Shirley Temple’s features (Choy 41). Her struggle comes in as Poh-Poh constantly reminds her of her cultural roots and where she belongs. In the novel, Poh-poh repeatedly tells Jook-Liang that she is not from Canada†¦ and that she is from China (Choy 34). In comparison of their situation as they struggle to identify themselves in the different aspect, Jung Sum is clearly portrayed to have a harder time even in the future.Not being able to be what he really is, his future would be oppressed as he suppresses himself, such that his secret would not be revealed. To put on a mask his entire life and never reveal his sexuality will take a toll on his adult life and he could never truly bring himself to enjoy his life as a whole. Jook-Li ang’s preference of either culture will still allow her to be accepted and although she may not gain the acceptance of one society, she will still gain the acceptance of another, allowing her to lead a normal life.Thirdly, both parties went through the turmoil of losing their loved ones, but Jung Sum had to experience losing many loved ones, losing his mother to violence Frank Yuen to the marines and even his pet turtle, Lao Kwei, to Dai Kew. On the other hand, Jook-Liang only had to experience losing her loved one, Wong Suk, as she never saw him again after he left to go back to China (Choy 71). From when Jung Sum was just a kid, life was tough for him as his father would often abuse him and his mother when he was drunk.His mother was the only one who would protect him from harm from his drunk father as Jung Sum would always be waiting for her to â€Å"tell him to stop†¦[and] twist against the falling belt and take the blows† (Choy 96). Having such a rough childh ood is scarring enough for Jung Sum and yet, he lost his mother at that young age. He went through various foster homes and eventually ended up with the Chen family where he finally found a place called home. In the Chen family, the life for him from the beginning was not exactly hard, as Father and stepmother treated him relatively well.However, he still took time to adapt and at his time with the Chen family, he discovered Lao Kwei and was ecstatic that he could finally own something, having something that he felt that truly belonged to him. Not long after, he lost his beloved turtle as his family decided that it would be okay for Dai Kew to claim back his turtle as he required it for his own personal purposes (Choy 85). Next, when he came to realize that he had a strong attraction to Frank Yuen, it was not long after that he Frank Yuen left him too.As Frank Yuen left to Seattle to join the marines, he left Vancouver and was not expected to return for the next few years (Choy 134) . It is evident that Jung Sum had to experience more pain and suffering than Jook-Liang as he had to repeatedly lose loved ones to different circumstances while Jook-Liang only had to go through that process once. This could cause Jung Sum to gain an insecure mentality that will cause him to always expect the least out of something, possibly causing him to lose hope in many things in the future.Although Jook-Liang may feel sad and depressed about the departure of Wong Suk, she would not have to endure the pain of losing another loved one anytime soon. Coming to a conclusion, both Jook-Liang and Jung Sum had to undergo many challenges and experiences as a child which could affect them as adults. Although Jook-Liang did experience tough trials during her childhood, Jung Sum was a victim of severe turmoil as a child and therefore, his experiences will affect him more as an adult. As a child, Jung Sum never had the opportunity of being showered with love by his own family as Jook-Liang did.Other than that, he also had to experience the pain of losing a loved one or a treasured pet a few times while Jook-Liang only experienced it once. Lastly, his homosexuality was adamantly not accepted by any society in the world at that moment in time while Jook-Liang had to only face the troubles of cultural identification, which still allowed her to be accepted by at least one type of society. All in all, Jung Sum had a tougher childhood experience than Jook-Liang and that would affect his adult life greatly in the future.

Best known for his theory of relativity and famous equation of E = mc2 the expression of mass-energy equivalence. In 1921 he received the Nobel Prize in Physics â€Å"for his service to Theoretical Physics, and his discovery of the law of the photoelectric effect. His numerous contributions to physics include his special theory of relativity, which brought together concepts of mechanics and electromagnetism, and his general theory of relativity, which was intended to extend the principle of relativity to non-uniform motion and to provide a new theory of gravitation. The physics community reveres Einstein; with over three hundred published scientific works and over one hundred and non-scientific works, Einstein’s influence on modern theoretical physics is irrefutable. In a broader sense, he is regarded as one of the most influential people in hu man history.In 1999, he was name Time magazine’s â€Å"Person of the Century†. Einstein became a German citizen in 1914, but showed feelings of being pressured into accepting Germany citizenship by the Academy. There were growing tensions in Germany after World War I towards Jewish people. Albert was not a practicing Jew but faced the same prejudice and injustice Jewish people across Europe would feel under Hitler rule. Einstein’s fears of a Nazi-ruled Germany came to reality in 1933 when Hitler was appointed Chancellor of Germany.Hitler's administration introduced the Law for the Restoration of the Professional Civil Service, which removed Jews and politically suspect government employees (including university professors) from their jobs, unless they had demonstrated their loyalty to Germany by serving in World War I. Einstein remained in Berlin until 1933 when he renounced his citizenship and emigrated to America to take the position at Princeton University. M eanwhile, in Germany, a campaign began to eliminate Einstein's work from the German lexicon. Activists published pamphlets and ven textbooks denigrating Einstein, and instructors who taught his theories were blacklisted. Albert’s upbringing and personal life form the foundation of Einstein, the man, the leader, and the genius. Jurgen Neffe sums up Einstein’s childhood with the line, â€Å"A child like Albert, in the view of the German-born American psychoanalyst Erik Erikson, ‘today would be subjected to specialized examination and, perhaps, to treatment. ’ Fortunately Einstein was spared that. † Einstein’s childhood was unique even to the standards of late Nineteenth Century Europe.Young Albert was not pressured into sports and social circles by his parents; instead left to create his own supplementary curriculum and study with his engineer uncle. Einstein had help developing intellectually but that was not the case with social interactions. As Albert grew he kept a childlike way about him except when it came to women. Neffe uses Albert’s love letters extensively to show his fascination with the other sex and derives, â€Å"Einstein’s correspondence with women invariably reveals he regarded [women] almost as playthings. However Neffe neglects to connect Albert’s early successful form of communication to his later dependence on written correspondence. According to Neffe, Albert was very successful with women but not at relationships. Neffe describes his interactions with his two sons and divorced wife as if they were circumstantial, but Albert clearly felt himself a better father and provider if the relationship was on paper. The seclusion Albert was then thrust into because of his divorce allowed him to delve wholly into his work.Albert Einstein’s will to think was engrained in his psyche at an early age. Neffe finds this point to be a singular incident. During this phase, one experience in particular made a â€Å"deep and lasting impression† on Einstein: the day â€Å"my father showed me a compass. † He was surprised that its needle always pointed in the same direction without being touched. â€Å"Something deeply hidden had to be behind things. † The initiation of a genius? The â€Å"miracle† sheds light on the enigma of his uniqueness only up to a point.Nearly every child is amazed at the sight of a quivering compass needle or some other baffling physical phenomenon. As Einstein advances in years he becomes more focused on his work. Albert’s personal studies are the only consistent force in his life and soon encompass his life. Einstein’s obligatory migrations forced him to completely embrace his studies as a defense mechanism. There is a childlike quality that remains present in many men considered geniuses, but fails to connect to Einstein’s upbringing.The focused, isolationist psyche developed in his youth stayed with the man and developed the genius. Neffe writes. â€Å"In addition to his contributions to the foundations of modern physics, he also made essential inroads in chemistry, provided the theoretical basis for the development of the laser, and, in his insatiable curiosity, answered questions such as why rivers bend and why the sky is blue. † Einstein’s isolation and devotion to his thoughts allowed him to develop his amazing theories.Neffe describes Einstein’s collaborations with other scientist and students in relation to work but does not fully describe the awkwardness that must have occurred between men of their nature. Einstein was turned down for many teaching positions and only received an honorary PhD. It is evident that every scientist greatly admires the dedication of Einstein to his work. A half-century after Einstein’s death, his theories, and the min d that spawned them, remain as baffling as ever to the public. Neffe offered a valid attempt to explain what created Einstein.He determines the defining moment of Einstein’s life at Nov. 6, 1919, the day when a joint session of Britain’s Royal Society and Royal Astronomical Society announced it had confirmed Einstein’s grandest idea, the general theory of relativity. According to the theory, gravity can generate enough force to bend light. Sir Frank Dyson, the Astronomer Royal, announced that the results left â€Å"no doubt† about the validity of Einstein’s prediction. Years later it was uncovered that the results in fact left considerable doubt, but Einstein’s supporters intuitively felt that the theory must be correct.The Times of London declared the finding â€Å"one of the most momentous, if not the most momentous, pronouncements of human thought. † Within days other media around the world followed. The Concept of New Media THE CONCEPT OF NEW MEDIA New Media as a term cannot be described by a single, uniform definition. This is because the concept of New Media evolves along with the development of technology and as the modes of communication progress and become in many ways, more instant. The concept of New Media takes definite form when the comparison between the old and the new mediums of communication takes place. In the present age, the mediums of television, recorders, radio and paper books have taken a back stage and the electronic mediums of communication have emerged triumphant. Today, the most popular and most instantaneous means of communication is the Internet which is the core element distinguishing new media from other forms. The popular definition of New Media is recognized with the use of a computer for the means of distribution and exhibition, by way of the internet, rather than with production. Thus, texts distributed via a computer are considered as New Media whereas those printed on paper, without the use of the computer and the internet are not. This Lev Monovich has labeled as the ‘culture of computerization.’[1] According to Monovich, the computer encompasses all mediums/methods of communication and affects all types of media, text, still images, moving images, sound and special constructions.[2] However, Monovich himself states that limiting the advent of New Media to the device of a computer is too limiting. Monovich lays down the following principles that determine new Media[3] – Numerical Representation Monovich states that all types and forms of New Media can be described mathematically, that is in terms of the binary code and so are numerical representations. Therefore, by applying appropriate algorithms, New Media can be manipulated. A cinematograph film for example is a sequence of images/frames, each of which has its own numerical representation.[4] Modularity This is also known as the ‘fractal structure of New Media’. Media elements consist of pixels, bites, characters, scripts, voxels etc, each of which combine to create the larger image, that is, what we see. However, each one retains its independent identity separate from the whole. Going back to the example of the cinematograph film, each frame would be independently created and would thereafter be combined together to create the whole cinematograph work. However, a single frame can thereafter be removed, altered or deleted without having an effect on the whole ‘work’. Automation The above two principles, that is Numerical representation and Modularity allow the work to be automated in many operations. For example, in cinematograph films software is programmed to automatically produce artificial life such as crowds of people as required in the film. Another more common example is when a computer automatically generates web pages when the user reaches the site. Variability An object of New Media is parallel to the idea of liquid. New media is not fixed in one definite format but can exist in a myriad of versions. New Media frequently changes as it is stored digitally with a numerical code. Thus, variability is a consequence of principle 1 – numerical representation and principle 2 – modularity. In order to get clarity, one can compare old media with new media. Old Media is created by a human creator who manually assembles the test, the images, and the video and audio elements in one particular format which then becomes fixed for perpetuity. Copies of the work can be made, but only identical copies can be made. In contrast, New Media, which constitutes numerous codes, changes each time it is generated. This is because, after it is created by the human creator, New Media then begins to be generated automatically which is what results in different versions. As New Media is stored digitally, in contrast to a fixed medium, each element retains its separate identity which can then be assembled into numerous sequences under the program’s control. Variability of New Media is created due to the following factors [5]– Media elements are stored on a media database Each time Media is created, different elements are used along with different numerical coding New Media can be displayed using a number of different interfaces The information about the user can be used by a computer program to automatically generate and customize the media composition New Media is through branching/menu based interactivity thus allowing the user to choose. This is when a user enters a programme; the user is given a number of options to choose from. The branch next advanced to in the program would depend upon the choice made by the user which for each user would not necessarily be the same. New Media contains objects that are periodically updated. Transcoding The fifth principle is the most significant, the cultural transcoding of media. This means that all data is turned into computerized data. While on the one hand computerized media still displays structural organization which is comprehensive to the users such as images, texts etc. on the other hand media follows the conventional structure of a computer’s organization of data. Therefore, New Media can be seen as two distinct layers, the ‘culture layer’ and the ‘computer layer’. The layer that can be viewed as a representation is the culture layer and the operating functions are the computer layer. Lev Manovich, in his introduction toThe New Media Reader, defined New Media by using eight propositions: Today, the increasingly rapid change in technological development is leading to rapidly changing forms of new media thus leading to new and unexpected methods of distributing and exhibiting copyrighted work. Methods of distribution or exhibition are constantly evolving and are modernizing hence giving old content new form and value. For example, the exhibition of performing arts has evolved from theater to pictures, television, videocassettes, LDs, DVDS, streamed videos and then to cell phone formats and tablet formats. A similar scenario has been witnessed in the music industry where the method of storing the data recorded has changed. Copyright Law, including the Copyright Act, 1957 grants authors an exclusive right over their creations.[6] Copyright in a work lasts for long durations. Section 22 of the Act states that â€Å"Copyright shall subsist in any literary, dramatic, musical or artistic work published within the lifetime of the author until sixty years from the beginning of the calendar year next following the year in which the author dies.† During this time, the value of the work and the circumstances surrounding its distribution would be liable to change considerably. To get a full understanding of the concept imagine that a newspaper publisher wants to release a compilation of articles on a CD-ROM and simultaneously wants to create an online database. There would be a possibility that a number of the authors would not be alive to give their consent to such distribution of their work. Finding the right holders to all articles to get them to agree to re-release the works would be prohibitively diff icult. Copyright laws across the globe have not enunciated on the copyright protection of ever-changing New Media. Thus, New Media will prove to be a highly contentious issue due to the gaping loophole in the law. As India has not expressly dealt with the issue of New Media as a challenge to copyright law this chapter will look at legislative reasoning in other countries before drawing a conclusion as to what India’s legislative development shall be in this respect. The legal landscape with respect to new use rights is bifurcated into two. While USA and the UK recognize new use rights and generally allow the free transfer of rights to unknown uses of copyrighted works, copyright grants are restricted in Germany, Spain, Belgium. CHAPTER___ COPYRIGHT PROTECTION OF TWEETS AND FACEBOOK POSTS Twitter along with Facebook epitomizes the term ‘social networking sites’ which allows a user to create a profile and regularly interact with other users. While Facebook allows posts and images to be uploaded on a user’s profile, Twitter is a real time application that allows public contact amongst the users. Thus, in the Internet age, Twitter and Facebook are the most commonly used social networking sites. Copyright issues with respect to one site will apply equally to the other site. Therefore, for discussion sake, the example of Twitter is chosen. ‘Tweets’, the posts by users on the site, are relatively simple as a mechanism. They are short in length as they cannot exceed 140 characters and on a general basis answer only one question.[7] Users on Twitter share stories, facts, information, breaking news, updates on world events, entertainment, sports etc. Twitter users can follow other users or vice versa and updated tweets would appear as and when they are posted.[8] Twitter, via its terms of service, declares that the user retains his/her rights to any content posted[9], therefore Twitter states that the user is entitled to the Intellectual Property Rights that get vested with the user as a result of any post. Alternatively, by signing up as a user on the Twitter website and making the content available to the public by posting tweets, the user grants a license to Twitter. The license includes Twitter’s right to make the content available to other organizations, companies etc.[10] Whether tweets on Twitter are copyrightable has, till date, not been a contentious issue in India. However, in the United States the copyrightability of tweets has been under debate. Therefore, to be able to culminate in a satisfactory answer, we first need to see whether a Tweet/post satisfies the requirements of the Federal Copyright Act. I will simultaneously transpose a similar argument in the Indian context. As per Section 102(a) of the Act, original works of authorship that are fixed in a tangible medium of expression, whether now known or later developed, are protected. Therefore, the pre-requisites for copyright protection under the Federal Act and the Indian Copyright Act, 1957 are – Originality The term ‘original’ has not been defined either under the Federal Act or under the Act of 1957. However, Section 13(1)(a) of the 1957 Act states that copyright shall subsist in ‘original literary, dramatic, musical and artistic works;’ which is indicative that copyright shall only extend to works that are the fruits of a person’s labour and skill. In the United States, it was observed in Alfred Bell Co. v. Catalda Fine Arts[11] that the term â€Å"’Original in reference to a copyrighted work means that the particular work ‘owes its origin’ to the author†. Further, in the landmark judgment of Feist Publications Inc. v. Rural Telephone Service Co.[12] it was observed that originality work that is directly attributable to the skill and labour of the author and that the work in question is independently created and is not a mere copy.[13] In order to be protected under the Copyright Act, 1957, a work must satisfy the criteria of ‘work’ as defined in Section 2(y) of the Act. In University of London Press v. University Tutorial Press[14] J. Peterson held that the word original does not imply that the work must be the expression of original or inventive thought. Originality as interpreted with respect to copyright protection relates to the expression of thought.[15] For a work to be considered original under the Copyright Act, it is sufficient if the contribution is minimal or poor. Work of Authorship The second pre-requisite for copyright protection to apply to any work is that the work must be a ‘work of authorship’. (continue) Fixation in a tangible medium The third element that is required for copyright protection is that a work is deemed created when it is first fixed, that is given a tangible form. This is parallel to the concept that an idea is not copyrightable but the expression of that idea is entitled to copyright protection.[16] Thus, if the idea is not made into a tangible medium, i.e. expressed, it cannot be protected by way of copyright. For example, in the field of literary work, the idea of the novel would not be copyrightable, but when the idea is expressed on paper in the particular manner of the author; fixation of the work would take place. For copyright protection, the medium, form and method of fixation of the work is not substantially consequential. Tweets create a challenge to the Copyright law and its application. However, the fact that Twitter’s Terms of Service include a Copyright Policy is indicative of the fact that the content on Twitter, including tweets, is copyrightable.[17] However, for a particular tweet to be entitled to copyright protection a tweet needs to satisfy the 3 basic requirements given above, a tweet must be an original work, it must be the work of the author and it must be in a fixed, tangible form. Whether a Tweet is entitled to Copyright Protection? To establish whether a tweet is entitled to Copyright Protection the following points are established – A tweet is an original work as the work is independently created. The users of Twitter post a tweet that is the result of their skill and labour. The Tweet meets the originality threshold stated in Alfred Bell Co.[18]however there is no specific reference to determine whether all Tweets are original. However, is it safe to say that some Tweets are original. As a corollary, it is seen that a tweet is a creative work. In Fiest it was held that the work must contain a modicum of creativity, â€Å"No matter how crude, humble or obvious ‘it might be.†[19]However, Phrases and words that have common, widespread usage cannot be copyrighted. A tweet is a literary work as stated under the Acts. As the term literary in the Federal Act connotes neither literary merit nor qualitative value, the term literary can have an expansive interpretation. Applying this standard, all tweets qualify as literary work. Further, to constitute a work of authorship, the work should be based on intellectual labour for which the content of the tweet must be examined. Generic, common phrases and questions cannot be works of authorship as they require no intellect in their expression. However, a poem, an expression, a joke is tweeted would be works of authorship because the work would be the result of intellectual labour as well as a literary work. A tweet is fixed in a tangible medium i.e., Twitter. Tweets cannot be viewed without the aid of a computer or any other device that can be connected to the internet.[20] Nevertheless, Twitter users face many challenges in meeting the three pre-requisites for copyright protection. This is due to the following reasons[21] – Size Tweets are very short in length, with a limit of 140 characters. Therefore, the word limit makes it impossible for the work to reach the level of creativity which is required for copyright protection. Content – It is well established that facts are not copyrightable. Tweets are mainly regarding notifications, events, gossip, and comments on political situations etc. Copyright law does not extend protection to facts and so tweets, despite their varying expressions, cannot be copyrighted. Scenes a faire – Tweets describe events, affairs, circumstances, scenes which cannot be expressed in more than a limited number of ways. For example, a tweet regarding the sunset will describe the sun as brilliant, or sunny, or bright. When an idea can be expressed in only a limited number of ways, such expression cannot be copyrighted as providing copyright protection to such an expression would be providing copyright protection to the idea itself.[22] Copyright in Quotes and Short Phrases Protection by way of Intellectual property rights over the most minimal of creative work has been regularly debated. Copyright protection of brand names, slogans, advertising mantras etc. have become a contentious issue. Courts are forever embroiled in the task of breaking down the exact meaning of the definitions provided in the statute. To get a better understanding of the boundaries of protection by the Act of 1957 some of the definitions provided are required to be repeated. Section 13 of the 1957 Act lays down that copyright protection is accorded on literary, dramatic, musical and artistic works, cinematograph films and sound recordings. Rights as provided in the statute can be exercised only by the owner of the copyright.[23] Quotes and short phrases are of two types. One type is cutting a small part from a longer sentence, example a book whereas the other type is when the quote stands on its own in entirety. Tweets would be form of the second type of quote/short phrases. Copyright protection to short phrases and quotes has been refused in a number of cases by the Indian courts. To claim a copyright infringement, the de minimis standard must be satisfied. Courts have refused to grant protection to slogans in advertisements, newspaper headlines for there is no copyright in a mere collection of words that is not a compilation. In this matter the law of trademark infringement and passing off has proved to be more useful. The underlying reason is that although such short phrases may be considered ‘works’ but they are unable to satisfy the requirement of originality. The resulting loss depends on the capacity of the population to support or resist the disaster, and their resilience. This perceptive is concentrated in the formulation: disasters occur when hazards meet vulnerability .A natural hazard will hence never result in a natural disaster in areas without vulnerability, e.g. strong earthquakes in uninhabited areas. The term natural has therefore been disputed because the events simply are not hazards or disasters without human involvement. Natural disasters which occur due to the change of plate tectonics are earthquakes, volcanoes, geyser eruptions and tsunami. These different types of natural disasters have taken away millio ns of lives and have caused trillions of dollars in terms of financial losses. The recent flood in Pakistan was one of the worst natural disasters in Pakistans history and in worlds history. It was one of the biggest disasters that the world have ever experienced not in terms of death but in terms of people affected, area affected and in terms of financial losses that occurred. Almost one- eighth of the population was directly affected by flood. The floods that recently caused great damage to Pakistan had more impact than the combine impact of tsunami in 2004, Haiti earthquake in 2010 and Earthquake of 2005 that affected northern areas of Pakistan. The affected people in these combine three disasters were around 11 million people but in the recent flood affected around 20 million people across Pakistan. LITERATURE REVIEW Effect on Agriculture Agriculture sector have been the backbone of the Pakistans economy and Pakistan is known as agriculture based country. According to the facts provide by the Food and Agriculture Organization (FAO), Agriculture is one of the main sector of Pakistans economy employing more than 42% of the labor force and accounts to 23% of the GDP (Gross Domestic Product). The recent floods did not only led to human loss but had a large impact on the agriculture sector directly. It destroyed many crops and over an estimated area of 1.38 million acres were affected due to recent flood of 2010. Pakistans major crops are cotton, wheat and rice. According to FAO although they have completed in half of all flood affected districts shows that 1.3 million hectares of standing crops have been damaged. According to their statistics 0.5-0.6 million tones of wheat stock have been affected. According to their Livestock Department recent flood caused death of 1.2 large and small animals, and 6 million poultry. Response to needs in the agriculture sector cannot be ignored nor delayed. According to their estimates standing crops on over 10,000 hectares have been washed away and nearly 8000 livestock have been destroyed in Khyber Pukhtunkhwa province alone. The worst affected districts are Swat, Nowshera, Charsadda, Shangla and Kohistan. Nowshera and Charsadda are the most fertile areas in the country producing variety of crops. Wheat is the main staple in Pakistan, fulfilling almost 35% of the average per capita calorie requirement in 2008. This year in Pakistan a record harvest took place for wheat around 23.4 million tones prior to flood, the flood water result in serious losses of wheat stocks that were held at household level. The loss of wheat can have a negative impact on the planting of next season which will begin in October/November because the flood have caused loss of seeds, fertilizers, livestock and savings. According to their estimates 1.2 million livestock and 6 million poultry have perished. One of the main reason that this figure is so high is because when people were rescued during the recent flood people did not take their animals with them and opted to save their life. The major challenge faced by different agencies working in Pakistan during this flood was to provide food to animals who survived as the supply was very limited and they face difficult task of transporting this food supply as majority of infrastructure was also destroyed. The United Nation has appealed for emergency assistant of $ 5.7 million for livestock. Cotton: It has been worst hit crop, as according to initial estimates we have lost as much as 2 million bales. This will direct impact on our textile industry and will lead to import of cotton. Effect on Economy The congressional research report that was present to the congress member on recent flood in Pakistan stated the economic effects of floods. According to them it is too early to assess the damage caused by flood and it can only be assessed once the water goes away to examine the extent of damage caused to crops, housing, roads and bridges, electrical grid and other critical elements to its economic recovery. According to the preliminary assessment done by the Asian Development Bank and FAO shows that around 14% of cultivated land has been affected by floods, that resulted in loss of 25% of the cotton crop and some other crops, Pakistan has also lost 1% of its livestock and there is danger of this percentage rising due to feed shortages and lack of veterinary care after the flood waters recede. The broader effect of flood can also be felt with price of domestic items soaring and creating high inflation. In addition to this government spending on relief activities is going to widen the fiscal deficit. According to United Nation Organization it estimates that the recent flood will increase Pakistans fiscal deficit expenditures by $4 billion in fiscal year 2010/11. A preliminary evaluation reported submitted to the Pakistans ministry of finance has estimated that there will be zero percent GDP growth and 25% inflation this year. The figure shows that Pakistan is going to face tough challenges ahead in year 2010/11 because the targets set by the IMF (International monetary fund) varied with these figures. IMF set a target of 4.5% GDP growth and with 9% inflation. The long-term economic effects are not easy to assess. According to one source, repairing damaged infrastructure that includes roads, bridges and dames would cost Pakistan whopping $15 billion. There are 44 critical factors that will hamper the speed of Pakistans economic progress over the next few years. Now Pakistan which is already face tough challenges since 2008 has the lowest TAX-GDP ratio in the world with figures acc ounting to 8-9 %. The World Bank and the Asian Development have agreed to give loans $ 1 billion and $2 billion respectively but they have also attached conditions to these loans. The IMF which have provided loan of $ 10-11 billion have asked Pakistan to review its monetary policy and fiscal policy. They have set targets for Pakistan and prior to these floods Pakistan have failed to achieve some of the targets set by the International Monetary fund. The IMF set condition of lowering fiscal deficit to 5.1 % during this year while Pakistan exceeded this limit and had a fiscal deficit of 6.2 % of the GDP, now that flood have occurred it looks impossible that Pakistan would be able to meet the targets set by IMF. Pakistan have to pay back the loan to IMF by 2012/13 and it would cost the country $3 billion per year. Pakistan external debt has already amounted to $55.5 billion which is 56% of the GDP. These figures are a prove that Pakistan which is already unable to meet the requirements set by the international donors will find it impossible to meet the target after the recent flood that have moved Pakistan decades back. According to CASSIM INVESTMENTS (PVT) LTD They have stated that since the entire infrastructure have been badly destroyed specially in Khyber Pakhtunkhwa and some areas of Punjab. All this will have to build to revive economic activity and thus this has forced the government to cut down is Public Sector Development Program by almost 50 % this means that all the development projects which were taking place in order to improve the economy have now been stopped and the funds have been shifted towards the flood affected areas. They have also stated that the imports of goods for relief purpose will widen the current account deficit. Foreign Aid will help the country in the short term, but will constrict the amount of PSDP available with the financial cost burden in the future. A current account shortage will cause devaluation of the currency, which is favorable for sectors for exports but if we see in our country it will have negative impact because depreciation would result in high inflation damaging Pakistans fiscal policy and monetary policy. According to an article in Daily Times on August 29 2010 it states that and we quote Government of Pakistan will revise its economic growth targets and major budget projections in consultation with International Monetary Fund (IMF), official sources informed here on Saturday. Economic growth targets and major budget projections for the 2010-13 were approved under the Medium Term Budgetary Framework for the next three years, however, the floods have changed the entire scene on the economic landscape of the country that requires major revision. Devastation caused by the floods across the country has seriously damaged the main sectors of economy especially the agriculture sector and Pakistans development priorities have changed and a major portion of resources are being planned to divert towards rehabilitation of flood affecters. Recent floods across the country have caused devastations worth Rs 244.6 billion in the agriculture sector with maximum damage suffered by the small farmers who have faced a loss of around Rs 98 billion, some facing total annihilation of their crops. Highlights are given below. Total Losses estimated at 5.8% of GDP. Around 15% of the Pakistani population has been affected by the floods. According to some initial estimates agricultural losses may exceed Rs 250 billion whereas infrastructure losses may exceed Rs 600 billion. Thus total estimated losses of around US$10 billion will equal 5.8% of Pakistans GDP. Economic Growth rate expected to be subdued. We expect agriculture sector to show a negative growth, and industry and services sector to grow by about 3%. We project corporate earnings to rise by 14% over the next four quarters, down from our previous estimates of 18% growth. Fiscal Deficit is expected to balloon to 7.5% of GDP in FY11. The slowdown in economy as a result of the floods will make tax collection target of Rs 1.7 trillion extremely difficult to achieve. On the other hand, government expenditures are expected to rise substantially to re-build the infrastructure in the floods-affected areas and rehabilitate the effected families. Domestic Government borrowing in the form of Treasury Bills and National Savings Schemes is also expected to rise substantially. In the months of July and August 2010, the Government Treasury Bills stock has already risen by about Rs 137 billion. This will also continue to crowd out the private sector. As a result, the budget deficit is estimated to cross 7.5% of GDP in FY11. Inflation and Interest Rates are expected to rise further. The imposition of value added tax from October, damage to crops from floods, projected rise in utility prices and expected additional taxes to support people affected with floods may result in inflation rising to around 15% in FY11. Stock Market performance expected to remain lackluster in FY11. Floods are expected to have a negative impact on the banking industry, auto industry and oil marketing companies, at least in the short run. In the remaining period of FY11 the stock market may not be able to show a double digit growth from the current levels. The Margin Trading System, even if implemented, is not going to make a significant difference to the performance of the Pakistani stock market, in my opinion, as the economic and political fundamentals will take time to improve. Trade and Current Account Deficit are expected to Rise. Pakistans exports will suffer due to damage to the key crops and textile sector resulting from floods, as well as power shortfall and high inflation. Effect on Banks The Moodys investor services changed the long-term local currency deposit ratings and bank financial strength ratings of the big-5 banks from stable to negative, said Muniba Saeed, an analyst at Invest Capital, here Saturday. The change in the outlook of the banks was driven mainly by the impact of flood giving rise to economic challenges. The food shortage and rising input prices will further hinder the corporate sectors recovery due to the slowdown in the economic growth and inflationary pressures. The rating agency expects that higher input prices would lead to a loss of competitiveness in certain export-oriented sectors, especially textiles. According to data from the State Bank of Pakistan, the banking sector exposure to textiles as of June stood at eight per cent of the total exposure, however, the banking sector exposure to cumulative textiles and the crop growing category of agriculture stood at 11 per cent of the total, or Rs635 billion. As textiles being the highest borrower in the manufacturing sector, such dependence are likely to dent the sectors profitability, owing to increased provisioning requirement and resultant increased probability of the non-performing loans. The banks non-performing loans (NPLs) have grown to an alarming level of Rs456 billion by March this year on the back of a sliding economy, according to the State Bank of Pakistan (SBP). The increasing NPLs are squeezing the profits of the banks, as they are required under the prudential regulations to make provisions against their bad debt. National Bank of Pakistan, the lender with the highest delinquency ratio, faces an increase in loan failures after the worst flooding in the countrys history damaged farmland in areas where the bank lends. Syed Ali Raza, the banks president, said in an interview in Karachi, There will certainly be some impact on non-performing loans. The impact will be containable but it will be there. He continued, While there were immediate losses from floods largely in the agriculture sector, there is a positive side to the disaster as it has refreshed farmland across the country. The yield from those farms is likely to improve with better, more fertile soil and availability of water in the next season. Abdul Shakur, a research analyst at BMA Capital Management Ltd. in Karachi said With around 25 percent of its total lending to agriculture related business, it will be a real challenge for National Bank to register growth in profit, He estimates a 22 percent decline in National Banks profit in 2010. Muhammad Imran, head of research at Arif Habib Investment Ltd. in Karachi said The flood losses and the discount rate rise may limit the ability of borrowers to return loans. Banks may be asked to reschedule and ease terms. The central bank said in an e-mailed statement Given the likely impact of the recent floods, ongoing challenging economic environment, power shortages and security situation in the country, the increased portfolio of non- performing loans and heightened credit risk remain the major challenge for the banking system. Effects on the Imports/Exports The recent floods in Pakistan have badly affected the Pakistans economy. The floods as caused a widespread destruction badly affecting the infrastructure, the farmlands and many industries. The floods have caused destruction to cotton, wheat and rice crops extensively thereby affecting the exports of finished products such as textile, and also raw material such as rice and cotton bales. According to the USDA Report, Due to the devastating floods, Post revises its 2010/11 rice production estimates for Pakistan to 4.4 MMT, a decrease of 32%. Pakistani rice exports for 2010/11 are similarly reduced to an estimated 2.3 MMT, a decline of 36%. Rice is Pakistans second largest export product and the reduction in rice exports is expected to have implications for its balance of payments. However the figures given for cotton are bleaker, as before Pakistan used to export cotton but now this year Pakistan is forced to import cotton from India and other countries to meet its own local demand and also in order to fulfill the export orders. According to Fibre to Fashion (a leading textile news website), More than one million bales of cotton crops have been destroyed, and the Government is not in the capacity to achieve its target of 14 million bales of annual production. Due to this, Pakistan, being Asias fourth largest producer of cotton is likely to fall back by 10-15% of its cotton production. Incessant downpour has damaged the fields in Piplan Layyah, Mianwali, and Mithankot. Regions in the Central Punjab such as Rajanpur, Lyia, Rahimyar Khan, and DG Khan were seriously affected losing thousands of bales of cotton crop. Areas of Ghotki, Daherki, Sukkar, and Naushehro Feroz, Bhakkar, Jhang, Shorkot, and Mianwali were also affected by floods. This devastation has badly affected the Pakistani industry as well, and the destruction would also create difficulties as the raw material would not be available; however there are some positive feelings that the cotton would be imported with already huge shipments in line and that would help in meeting the international export orders. We have found articles and reports on internet that have been previously written on this topic. We have collected facts and figures from websites of NGOs, Social welfares and government. We have conducted interviews with the NGOs and the welfare organizations to try to get the answers of our research questions. One of our group member also went to the affected places to try to know the ground situation. We have divided our research question into four categories and found their answers individually as well. We have gathered around 40 articles and from that we have shortlisted 17 articles. A Reaction Paper to: â€Å"How Moral Are You?† by Kohlberg, L. (1963); The Development of children’s orientation†¦of moral thought & â€Å"Telling The Truth† by Barasch, Douglas S.(Family Life)   Ã‚  Ã‚  Ã‚  Ã‚   I read both of these articles and found them to be interesting. In the first article, â€Å"How Moral Are You?† published in Forty Studies that changed Psychology IV by Roger R. Hock, what is discussed is Lawrence Kohlberg’s research on the formation of morality. Kohlberg believed the ability to moralize situations encountered in life develops in a specific pattern during our childhood years. He believed that a child must reach a certain stage and mentality in order to create a level of morality. I found the information he presented was interesting. Things such as: each ‘stage’ a child undergoes increases the understanding of the concept of morality and the stages always occur in a step-by-step pattern. Kohlberg reasoned the stages are â€Å"prepotent,† meaning the child understands every stage that he/she has been through and a vague idea of the stage above them (197). As for how he researched his theory, the process seems simple enough. He supplied children of different ages with â€Å"10 hypothetical moral dilemmas†(197). I found myself answering the questions about moral issues with confusion. The question that was most difficult to answer was the ‘Heinz Dilemma’ in which a man commits a crime to save his wife from dying. I would forgive his [the husband] actions because the druggist was being unfair in his offering price for his medicine. That kind of druggist shouldn’t be allowed to be creating drugs anyway†¦his job is to aid people not the antithesis.   Ã‚  Ã‚  Ã‚  Ã‚  I enjoyed reading this article but conceived of a few flaws in his theory that he [Kohlberg] did not address though many other critiques did. The glitches in his theory were such as: although Kohlberg represents an interpretation of morality, most of these ideas represent Western culture’s and failed to apply to non-Western cultures. It was also difficult to apply his theory equally for both men and women. He did a wonderful job of explaining morality even though it would not stand up on it’s own in the years to come.   Ã‚  Ã‚  Ã‚  Ã‚  The second article I read, I found to be similar to my first in the fact that they both discussed moral reasoning of children and different so-called ‘stages.’ It was published by Douglas S. Intent and Motive in The Devil and Tom Walker and The Devil and Daniel Webster  Ã‚     Ã‚   Washington Irving, in writing "The Devil and Tom Walker", and Stephen Vincent Benet, in writing "The Devil and Daniel Webster" illustrate to the reader the consequences of man's desire for material wealth and how a person's motivation for a relationship with the devil affects the outcome of the "deal". In these two different, yet surprisingly similar narratives, the authors present their beliefs about human intent and motive. In "The Devil and Tom Walker", the story is seen of a stingy man and his nagging wife who "...were so miserly that they even conspired to cheat each other" (128). In the story, one sees a man make a deal with the devil, who in the story is known as "Old Scratch", for the sole purpose of personal gain. Tom Walker, seeing only the possible wealth that he could achieve, bargains with the devil and finally reaches an agreement which he sees to be fair. Tom does not see the danger present in bargaining with such a powerful force for so little gain. There is a note of humor present in the narrative, which adds to the sense of danger that is present making deals that one does not intend to keep. Commenting on the story, Larry L. Stevens notes that "This tale,..., comically presents the results of valuing the dollar above all else." This story does a very good job of conveying a message to the reader about human values. In the story Tom is seen as a very self-centered man who cares only for himself and his own well being. He is not even phased when he discovers the remains of his wife hanging in a apron in a tree; "Tom consoled himself for the loss of his property with the loss of his wife" (132).
